WikiLeaks' Assange can continue extradition fight

(AP) ? WikiLeaks founder Julian Assange was granted permission by judges Monday to continue his legal battle to avoid extradition to Sweden over sex crimes allegations ? but was warned that his chances of success are slim.

At a hearing at London's High Court, senior judges John Thomas and Duncan Ouseley said Assange would be allowed to apply to Britain's Supreme Court to argue that Europe's process of carrying out extradition was flawed.

The WikiLeaks' chief now has 14 days to submit a written request for a hearing at the country's highest court, Gareth Peirce, a lawyer for Assange, said outside court.

The decision means Assange won't face immediate deportation, and is likely to spend a second Christmas living under curfew at a supporter's country estate in eastern England.

Assange's legal team argue that police and prosecutors ? like the Swedish prosecutor seeking to bring Assange back to the country for questioning ? are not a proper judicial authority, and shouldn't have the right to order extraditions.

Judges said Assange's lawyers had raised a legal question of "general public importance," which is necessary to win an audience at the Supreme Court. But Thomas added that the appeal's "chances of success may be extraordinarily slim."

Assange, who listened attentively and scribbled notes throughout the hearing, was cheered by a small group of supporters ? including several demonstrators from the nearby Occupy London encampment ? as he left the court.

"The High Court has decided that an issue that arises from my own case is of general public importance and may be of assistance in other cases and should be heard at the Supreme Court," Assange said on the steps of the courthouse.

"I think this is the right decision and I am thankful. The long struggle for justice for me and for others continues," he said.

Assange, 40, leads the foundering WikiLeaks anti-secrecy movement, which has been hit with a series of legal and financial setbacks. He was accused of rape, coercion and molestation following encounters with two Swedish women in August 2010. Swedish authorities issued a European Arrest Warrant on rape and molestation accusations, and Assange was arrested in London in December 2010.

Assange was released on bail on the condition that he lives under curfew and wears an electronic tag.

In February, Judge Howard Riddle ruled that Assange can be extradited to Sweden to face questions about the allegations, rejecting his claims that he would not receive a fair trial there.

Assange appealed against the decision. He also insists that the sexual encounters were entirely consensual, and legal in the context of English law.

Judges said Monday that they believed Assange would have faced charges if the incidents had taken place in Britain.

Per E. Samuelsson, Assange's Swedish lawyer, hailed the court's decision to allow him to continue his legal fight.

"This is positive news for Julian Assange and means he will remain in the U.K. while the court assesses his appeal," Samuelsson said. "It is something we have fought for."

Claes Borgstrom, the lawyer representing the two women bringing sex crime charges against Assange, called the decision regrettable.

"My clients have waited for over a year for a legal conclusion of this and now they will have to wait even longer," Borgstrom said. "Then it will still end with Assange being transferred to Sweden. The rules are very clear about this."

"I regret he himself doesn't choose to hand himself over," Borgstrom added.

He said the two women had hoped that the case would have been settled at Monday's hearing. "Now they have to wait for another few months. We are hardened by now, but of course this is still stressful," he said.

Peirce said a panel of three Supreme Court judges will review Assange's appeal for a hearing at the court. If accepted, it could be several more months before his fate is decided conclusively. However, if the judges reject the plea for a hearing, Assange could be sent to Sweden within 10 days, she said.

The High Court judges appealed to their colleagues at the Supreme Court to resolve the case as speedily as possible.

"We would, for obvious reasons, ask that the point is decided as quickly as possible," Thomas told the hearing.

Outside the court, masked members of the hacker group Anonymous and supporters of the Occupy protest ? some of whom wore the cartoon-style masks that have become synonymous with the demonstration, mingled with WikiLeaks activists.

One banner draped over railings outside the court read "Free Assange. Free Manning," referring to U.S. Army analyst Bradley Manning who is in custody at Fort Leavenworth prison in Kansas, suspected of disclosing secret intelligence to WikiLeaks.

Falkenblog: Investing Rule


I was on the Chicago Tribune website, and the top banner ad contained the following picture links to a site promoting penny stocks. The link went to a site with those annoying pop-up ads that are difficult to destroy. I think a good investing rule, or at least guideline, is to not buy stocks promoted at websites with half-naked women. Another might be to avoid investments that present +1000% returns as examples (see here or here), which are often common on these sites. As mentioned, average penny stock returns are pretty dismal, the ultimate lottery stocks.

Obama sets new U.S. goal on fighting AIDS (Reuters)

WASHINGTON (Reuters) ? President Barack Obama vowed on Thursday to bolster U.S. efforts to fight AIDS, setting a new goal of providing treatment to 6 million people worldwide, up from the earlier goal of 4 million.

Obama, at a World AIDS Day event, also challenged other nations to boost their commitments and called on China to "step up" as a major donor in the effort to expand access to AIDS drugs.

"We can beat this disease. We can win this fight. We just have to keep at it, today, tomorrow, and every day until we get to zero," Obama said at the forum, where he credited his Republican predecessor, George W. Bush, for his efforts to combat AIDS and HIV.

"As we go forward, we need to keep refining our strategy so that we're saving as many lives as possible. We need to listen when the scientific community focuses on prevention," Obama said.

He said the United States was also setting a goal of providing anti-retroviral drugs to more than 1.5 million HIV-positive pregnant woman worldwide over the next two years.

Bush, who sought to make the fight against AIDS and HIV a signature issue of his presidency, spoke by satellite to the Washington event, which was sponsored by the ONE campaign, a grassroots advocacy organization dedicated to fighting poverty and preventable disease, particularly in Africa.

Also part of the lineup of speakers were Democratic former President Bill Clinton, U2 lead singer Bono, singer Alicia Keys and Florida Republican Senator Marco Rubio. Like Bush, Clinton participated by satellite.

U.S. AIDS PROBLEM

Obama also announced a $50 million increase in spending on HIV and AIDS treatment in the United States. The funds would come from existing resources and would not require congressional approval, a White House official said.

Only 28 percent of the 1.2 million Americans living with HIV have the infection under control, increasing the risk that they will spread the disease to others, according to research by U.S. health officials published this week.

Part of the problem is that one in five U.S. adults infected with HIV do not know it and of those who are aware, only half receive ongoing medical care and treatment, the Centers for Disease Control and Prevention said in a report.

The AIDS issue seemed to prompt a rare instance of bipartisan agreement at a time when Democrats and Republicans have been bitterly divided over tax policy and spending cuts.

"Look back and you'll see that both Republicans and Democrats in Congress have consistently come together to fund this fight," Obama said. "That's testament to the values that we share as Americans, a commitment that extends across party lines and that is demonstrated by President Bush and I joining you all today."

In his remarks via satellite from Tanzania, Bush said he understood that many nations, including the United States, were struggling with their budgets.

But he said wealthy nations had an obligation to make the fight against AIDS a priority.

"We're a blessed nation in the United States of America, and I believe we are required to support effective programs that save lives," Bush said.

PFT: Angry Reid defends Jackson's effort

Eagles coach isn?t upset with DeSean Jackson. He?s upset with how NFL Network portrayed Jackson during Thursday night?s game.

Reid said at his Friday press conference?that he was ?very, very disappointed? with the network?s coverage.

?DeSean, I?m going to tell you now, DeSean was all in that game,? Reid said. ?He had a great attitude during that game, and you can take a camera and make some things look the way you want to make them look, but that kid was all in last night, and I was proud of him for that.?

On one play, Jackson was shown not looking back at Young as he ran deep with inside position on a defender. Reid said the play was designed to go to Jason Avant and Jackson?s job was to clear the defender out.

(Uh, but Young still has the option to go to Jackson if he wants.)

Reid also didn?t like how NFL Network said Jackson wasn?t talking to his offensive teammates all night. ?Cameras showed Jackson zoning out when Vince Young was talking to him. ?(Later, they did show Jackson talking to teammates.)

?I am not sure they know who?s talking to who and so on and what the conversation is about,? Reid said. ?Not knowing the language, I don?t know how you are able to go into that stuff . . . ?This is petty stuff.?

We understand Reid wants to defend his players. He doesn?t want to lose Jackson the rest of the way and knows Jackson is taking a lot of heat locally.

But they eye in the sky doesn?t lie. NFL Network showed multiple times during the post-game show where Jackson jogged on his routes.

Reid can?t just declare Jackson was all in when the cameras told a different story.

Australian boy, 14, jailed for drug use in Bali

A Bali court sentenced a 14-year-old Australian boy to two months in jail on Friday for possessing a few grammes of marijuana, a lighter sentence than sought by prosecutors after Canberra asked for leniency.

The teenager is likely to be released in early December, a prosecutor said, having already served time since his detention in October.

Australia pushed Indonesia for leniency in a case that has sparked controversy given his age, and its Foreign Minister Kevin Rudd welcomed the court verdict that he said meant the boy and his family would probably be back home by Christmas.

The teenager was on holiday in Bali when he was allegedly found with 3.6 grammes of marijuana.

A lawyer for the boy said his parents would not appeal the court decision to give him a two-month term, which was lighter than the prosecutors' demand for three months.

Indonesia has a maximum penalty for drugs possession of 12 years in jail, and smugglers can face the death sentence.

In past cases Australians have received heavy sentences for attempting to smuggle drugs, a source of tension between the two neighbors.
